1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • names
  • phone numbers
  • email addresses
  • usernames
  • passwords

Sensitive Information. We may process certain data that may be considered sensitive under U.S. state privacy laws, such as precise geolocation (when enabled) and, where applicable, account credentials. We process sensitive data only for permitted purposes (e.g., providing and securing the Services, compliance features) and, where required, we obtain your consent and provide the right to limit our use and disclosure of sensitive data.

Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:

  • Geolocation Information. With your permission, we may collect precise geolocation data from your mobile device (including in the background where you enable “Always Allow”) to provide core functionality such as HOS/ELD compliance features, safety and troubleshooting. You can disable location access in device settings; certain features may not function properly. We do not use precise geolocation for targeted advertising.
  • Mobile Device Access. We may request access to device features (e.g., Bluetooth for pairing, camera for scanning, microphone only if you use voice features, and SMS only if you enable SMS-based features). We collect data from these features only when you actively use or enable the relevant feature. You can control permissions in device settings.
  • Mobile Device Data. We automatically collect device identifiers and technical data (e.g., device ID, OS version, app version, IP address, carrier, crash logs, and diagnostic events) to operate, secure, and improve the Services, troubleshoot issues, prevent fraud, and for analytics.
  • Push Notifications. We may send transactional and service-related push notifications (e.g., account, compliance alerts, system messages). You can opt out via device settings.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Google API. If you connect Google services, we access only the data necessary to provide the requested feature. We do not use Google user data for advertising, do not allow humans to read it except as necessary for support with your consent, and we comply with Google API Services User Data Policy, including Limited Use requirements.

Information collected from other sources

In Short: We may collect limited data from public databases, marketing partners, and other outside sources.

We may receive business contact and professional data (e.g., company, role, business email/phone) from data providers or marketing partners to maintain and update our records and to identify prospective business customers. Where required by applicable U.S. state privacy laws, we provide opt-out rights for targeted advertising/profiling and honor universal opt-out signals (e.g., GPC). You may opt out of targeted advertising where required by state law; we honor GPC where required.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process personal information to: (a) provide and operate the Services (including ELD/HOS compliance features), (b) authenticate accounts and provide customer support, (c) secure the Services, prevent fraud, and enforce terms, (d) perform analytics and improve performance, (e) communicate with you about the Services, and (f) comply with legal obligations. If we run promotions/contests, we will provide additional terms and disclosures at the time of collection.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

  • To respond to inquiries and requests submitted through our website
  • To provide, operate, and improve our products and services
  • To communicate with you regarding account setup, onboarding, support, and service-related matters
  • We may use contact information you provide to respond to inquiries, schedule demos, and send service and promotional communications. You can opt out of marketing emails at any time. For marketing calls/texts, we obtain consent where required by law and provide opt-out mechanisms.
  • To send product updates, service announcements, promotional offers, and other information that may be relevant to your business
  • To analyze website usage and improve user experience
  • To comply with legal obligations and enforce our terms

4. MARKETING & SALES COMMUNICATIONS

If you provide your contact details, we may send you marketing emails consistent with applicable law. You can opt out by using the unsubscribe link; we honor opt-out requests within the timeframe required by law (typically up to 10 business days).

Marketing Calls & Texts (Telephone/SMS). Where required by law (including the TCPA), we will obtain your prior express written consent before sending marketing texts or placing marketing calls using automated technology or prerecorded/artificial voice. Consent is not a condition of purchase. You can opt out of texts by replying STOP, and you can opt out of calls by telling us during a call or contacting us at info@eld88.com.

These communications may include:

  • Follow-up calls or emails from our sales team
  • Product demonstrations and onboarding information
  • Promotional messages, special offers, and service updates
  • Marketing or informational newsletters

You may opt out of receiving marketing communications at any time by:

  • Clicking the “unsubscribe” link in our emails, or
  • Contacting us directly at the email address provided below

Opting out of marketing does not affect transactional/service messages such as account notices, security alerts, billing, or compliance-related communications.

5. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

We may share personal information with: (a) service providers (processors) that help us operate the Services (hosting, support, analytics, communications), (b) affiliates (if applicable) under this Notice, (c) business partners only where necessary to provide requested services or with appropriate disclosures, and (d) in connection with corporate transactions. If an “offer wall” or similar advertising feature exists, we will identify the provider(s), the data shared (e.g., user ID, device identifiers, approximate/precise location), and provide opt-out rights where required.

6. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In Short: We are not responsible for the safety of any information that you share with third parties that we may link to or who advertise on our Services, but are not affiliated with, our Services.

The Services, including our offer wall, may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third-party websites. Any data collected by third parties is not covered by this Privacy Notice. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions. When you leave our Services, third parties’ practices apply. We encourage you to review their privacy notices. We are not responsible for third-party tracking technologies on their sites.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We retain personal information only as long as reasonably necessary for the purposes described, including to provide the Services, comply with law, resolve disputes, enforce agreements, and support customers’ compliance needs. We maintain a retention schedule by data type (e.g., account data, support tickets, device logs, ELD/HOS records, geolocation history) and delete or de-identify data when no longer needed, subject to legal/contractual requirements and secure backups.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We use administrative, technical, and physical safeguards (access controls, encryption in transit, monitoring, least-privilege). However, no system is 100% secure.

9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to minors.

This service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from minors. We do not knowingly sell or share personal information of minors. If we become aware that we have collected personal data from a minor without verified parental consent, we will take steps to delete that information.

10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state, you may have rights to access, correct, delete, obtain a copy, and opt out of targeted advertising, certain profiling, and (where applicable) the sale/sharing of personal information. Where required, we provide a method to exercise these rights and will verify requests. You may also have the right to limit use/disclosure of sensitive data (e.g., precise geolocation) where applicable.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

We honor Global Privacy Control (GPC) where required for opt-outs; DNT is a different browser signal and is not universally recognized.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We will not sell or share personal information in the future belonging to website visitors, users, and other consumers.

Your Rights

You have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights include:

  • Right to review, understand, question, and correct how personal data has been profiled (as permitted by applicable law, including the privacy law in Minnesota)
  • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including the privacy law in California)
  • Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including the privacy law in Florida)

How to Exercise Your Rights

You may submit requests via: (a) DSAR form, (b) email, and (c) a toll-free number for California residents (where applicable/required). We will respond within statutory timelines applicable to your state and may request verification.

We will honor your opt-out preferences if you enact the Global Privacy Control (GPC) opt-out signal on your browser.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at info@eld88.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?"
